These Terms and Conditions (“Terms”) govern your use of kosmospc.com and any purchase of products or services from Kosmos Hosting Services (“we,” “us,” “our”), based in Troy, Michigan. By placing an order or using our site, you agree to these Terms.
Our services
We sell a mix of digital downloads (WordPress themes), repair services (computer, laptop, tablet, and game console repair, data recovery), custom-built gaming computers, custom website builds, and subscription services (hosting plans and our Gaming VPN service). Each of these is also covered by our Refund and Returns Policy, which forms part of these Terms.
Orders and payment
All prices are listed in US dollars and are subject to change without notice until an order is placed. Payment is due at the time of order unless otherwise agreed in writing. We reserve the right to refuse or cancel any order, including for suspected fraud, pricing errors, or inability to fulfill the order, in which case you will be refunded in full.
Digital products (themes)
When you purchase a theme, we grant you a non-exclusive, non-transferable license to use it on your own site(s) as described on the product page. You may not resell, redistribute, or claim authorship of our themes. Digital downloads are final sale, as described in our Refund and Returns Policy.
Repair and custom build services
Turnaround times for repairs and custom builds are estimates, not guarantees, and can be affected by parts availability or diagnosis findings. We’ll contact you before performing any work beyond what was originally quoted. Devices left with us for more than 30 days after we notify you that work is complete may be subject to a storage fee or considered abandoned, consistent with Michigan law.
Custom websites
Custom website projects are scoped individually. Delivery timelines, revisions, and ownership of the final files are as agreed between you and us in writing (email or contract) before or during the project.
Hosting and VPN services
Hosting plans and the Gaming VPN service are billed on a recurring basis as selected at checkout. We aim for high uptime but do not guarantee uninterrupted service; scheduled maintenance will be communicated in advance where possible. You are responsible for the legality of content you host or transmit through our services.
Acceptable use
You agree not to use our services for any unlawful purpose, to distribute malware, to infringe on others’ intellectual property, or to abuse or overload our infrastructure. We may suspend or terminate service for violations of this policy.
Limitation of liability
To the fullest extent permitted by law, Kosmos Hosting Services is not liable for indirect, incidental, or consequential damages arising from use of our products or services, including data loss. We recommend backing up your data before any repair or hosting migration. Our total liability for any claim is limited to the amount you paid for the product or service in question.
Changes to these Terms
We may update these Terms from time to time. Continued use of our site or services after changes are posted means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.
